When Judges Rule Constitutionally Justice Is Served

In the midst of judicial tyranny, a spark of hope flares from time to time when a judge breaks away from what the God-haters want. Last year, a high school student brought a lawsuit against the Matawan-Aberdeen school district in New Jersey on the basis that the Pledge of Allegiance, which includes the words “under God,” violated his rights as an atheist when it is recited in class. 

If only these young people were taught the U.S. Constitution and their State Constitution maybe they would be more appreciative of their country. Becoming familiar with the founding documents and the Christian history of this nation would make them think twice before going to the courts. This also applies to every citizen and organization like the American Civil Liberties Union [ACLU] who constantly, under the falsehood of the separation of church and state, has wreaked havoc throughout the nation and continues to do so; they always find judges that will side with them or schools that are unwilling to fight back. 

Occasionally, atheists cross paths with someone who stops them dead in their tracks like District Superior Court Judge David Bauman who, in his 21-page decision issued on February 6, dismissed the case; his ruling was published on Monday, May 11, 2015.  Judge Bauman made the reasons for his disagreement clear to the unidentified high school student. 

Opposing Views wrote an article about Judge Bauman’s decision and it reads in part:

“[T]he words ‘under God’ do not violate rights guaranteed to individuals under the New Jersey Constitution. … 

“‘Under (the association members’) reasoning, the very constitution under which (the members) seek redress for perceived atheistic marginalization could itself be deemed unconstitutional, an absurd proposition which (association members) do not and cannot advance here,’ Bauman wrote. … 

“‘Although the child whose family brought the case may feel «marginalized» by the phrase «Under God», that’s not sufficient reason to remove the words,’ Bauman said.”

The Conservative Tribune also reported on the judge’s decision:

“Protecting students from viewpoints and ideas that may offend or upset them is not and has never been the role of public schools in America, …

“As a matter of historical tradition, the words ‘under God’ can no more be expunged from the national consciousness than the words ‘In God We Trust’ from every coin in the land, than the words ‘so help me God’ from every presidential oath since 1789, or than the prayer that has opened every congressional session of legislative business since 1787.”

The blog also reported on the judge’s comment that: “even the New Jersey State Constitution references God, meaning that ‘the very constitution under which’ the student sought ‘redress for perceived atheistic marginalization could itself be deemed unconstitutional,’ a notion the judge described as ‘absurd’.”

Now let us read what the Preamble of the New Jersey State Constitution of 1947 says:

(UPDATED THROUGH AMENDMENTS ADOPTED IN NOVEMBER, 2014)

 A Constitution agreed upon by the delegates of the people of New Jersey, in Convention, begun at Rutgers University, the State University of New Jersey, in New Brunswick, on the twelfth day of June, and continued to the tenth day of September, in the year of our Lord one thousand nine hundred and forty-seven.

We, the people of the State of New Jersey, grateful to Almighty God for the civil and religious liberty which He hath so long permitted us to enjoy, and looking to Him for a blessing upon our endeavors to secure and transmit the same unimpaired to succeeding generations, do ordain and establish this Constitution.

Judge David Bauman did what his oath of office demanded him to do: “I, do solemnly swear (or affirm) that I will support the Constitution of the United States and the Constitution of the State of New Jersey, and that I will bear true faith and allegiance to the same and to the Governments established in the United States and in this State, under the authority of the people So help me God.”

Do you think the atheists are going to walk away from this fight regardless of how clear the Constitutions say we are a nation in relation to the God of all creation and the Sovereign Ruler of the nations? Don’t count on it, their goal is to silence Christians and erase our American Christian heritage. Their vision for the future of America is to make her a godless nation. The question remains, what future do Christians want for this country and the world? 

John Adams said: “Our Constitution was made only for a moral and religious people. Is wholly inadequate to the government of any other.”

When Adams used the term, “religious people” it was in reference to biblical Christians.  Christianity was the faith of the majority of the population before, during and after the War of Independence.

His cousin, Samuel Adams said, “Neither the wisest constitution nor the wisest laws will secure the liberty and happiness of a people whose manners are universally corrupt.”

It is not enough to call ourselves Christians; we must be living examples of what it means to live the life of God in the Spirit here and now. People who don’t know God should be able to know Him by scrutinizing our lives and come to the conclusion that we have something they long to have. Then perhaps their hearts will be open to hear about the salvation and Lordship of Christ. On the other hand, if they do not hear or see anything different there is no challenge or appeal for them to change. This will only encourage them to disciple the nation towards ungodliness. 

“And you, son of man, say to your people, The righteousness of the righteous shall not deliver him when he transgresses, and as for the wickedness of the wicked, he shall not fall by it when he turns from his wickedness, and the righteous shall not be able to live by his righteousness when he sins.” Ezekiel 33:12

Christians in name only cannot fool God, none of us can. If we are genuine He will know and others will know as well. This is the reason God makes it clear that if we stop being righteous we become worse than the unbeliever and our life is in serious trouble, however, we can take comfort in knowing that the way to restore our relationship with the Godhead is through repentance, turning from our wicked ways and letting God use us for the healing of the nation.
